These terms govern your use of this website and any order you place through it. By browsing the site or placing an order you accept them.

Who these terms cover

This website is operated by BROIL Sensotek Industries ("BROIL", "we", "us"). Using the site, subscribing to a service or placing an order means you have read these terms and agree to be bound by them for as long as you keep using the site. If you do not agree, please do not use the service.

We may revise these terms at any time without individual notice, so it is worth checking this page from time to time. If you want to query anything here, or you have a comment or a complaint about the website, write to info@broiltech.com.

What you may not do

The following count as misuse of the website and are not permitted:

• Sending or spreading harmful code — viruses, trojans or any other malicious software.
• Posting or transmitting anything obscene, or anything that promotes racism, bigotry, hatred, child abuse or physical harm against any person or group.
• Sending junk mail, spam or chain letters.
• Promoting illegal activity, or conduct that is abusive, threatening, obscene, defamatory or libellous.
• Posting unsolicited promotional or advertising material.
• Reproducing or distributing copyrighted material, trademarks or other proprietary information without the owner's written consent.
• Sharing pirated software, music or links to it, or information on defeating copy protection.
• Publishing instructions for illegal activity, or posting images or video of another person without their written consent.

We accept no liability for damage caused to your software, data or device by content downloaded from this website.

Intellectual property, software and content

Everything published on broiltech.com is protected by worldwide copyright law and belongs to BROIL Sensotek Industries. Modifying, misusing, translating or building derivative work from the site content is prohibited. Any use of this website or its contents beyond your own personal, non-commercial use needs our permission first. See the Trademark notice for the detail on marks and logos.

Registration and security

• Once registered you will get a confirmation email at the address you gave us.
• Keeping your password and account confidential is your responsibility, as is everything that happens under them.
• Tell us straight away about any unauthorised use of your account or any other security breach.
• BROIL cannot be held liable for loss or damage arising from a failure to keep those details safe.

Pricing and product accuracy

We take care to make sure prices are correct at the time of publishing and that every product is described fairly. All prices are shown inclusive of GST. If a product price is listed incorrectly and you place an order against it, we will contact you by phone or email before proceeding.

Product colours are reproduced as accurately as we can manage, but what you see depends on your monitor, so we cannot guarantee an exact match on delivery. Props shown in product photographs are not included — only the product itself ships.

Everything displayed on this site is an invitation to offer. Your order is the offer, and it is subject to these terms. We may accept or reject an order in whole or in part. Acceptance happens when the goods are dispatched; if you gave us an email address we will confirm receipt of the order and then confirm dispatch.

Who can order

You may use this site only if you can form a legally binding contract under applicable law. People who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 — including undischarged insolvents — are not eligible.

Unless stated otherwise, the material on this site is directed at users accessing it from India. If you access it from elsewhere, complying with your local law is your responsibility. We deliver within India at nominal cost; on international orders customs duty may apply and is payable by you.

Some Indian states restrict direct sale of goods from other states or require special documentation to avoid dual taxation. Where an order comes from or is bound for such a state, we reserve the right to accept or reject it, and we will not be liable for claims relating to products ordered from restricted states.

Order cancellation

Cancelling within 24 hours of placing the order gets a 100% refund. Cancellations between 3 and 6 days carry a 20% fee. Our full Cancellation Policy sets out the grounds in detail.

There are orders we may be unable to accept and must cancel — limited stock, an error in product or pricing information, or a flag raised by our fraud checks. We will tell you if all or part of your order is cancelled, or if we need more information to accept it. If your card was already charged, the amount is reversed to the same card account.

We seek authorisation on your card for the total order value, but may capture only the portion we can actually fulfil, plus associated shipping, taxes and levies. Any surplus authorisation not captured within our merchant banker's window simply lapses. If something is charged in error we refund it as soon as we notice or you tell us, whichever is sooner.

Payment and financial details

You confirm that the card or financial details you give us are correct and lawfully yours to use. Financial information goes directly to our acquiring bank and is not stored by BROIL. We are not liable for card fraud; liability for fraudulent card use rests with you, and the burden of proving otherwise is yours.

On receiving your order we run a standard pre-authorisation check to confirm sufficient funds. Goods are not dispatched until that check completes, and your card is debited once the order is accepted.

BROIL and its acquiring banks reserve the right to recover the cost of goods, collection charges and legal fees from anyone using the site fraudulently, and to begin legal proceedings for fraudulent use or any other breach of these terms.

Insurance and delivery

Every purchase is insured while in transit until it reaches your delivery address. A signature is required on delivery, and responsibility passes to you at that point. If you nominate someone else to receive the goods, their signature at that address is evidence of delivery and of our fulfilment.

We aim to dispatch all orders within 48 hours. Delivery estimates run from the dispatch date and are usually 5–7 business days; sale periods can add to that. We are not responsible for delays caused by destination customs clearance. Full detail is in the Shipping Policy.

Discount codes

We occasionally issue promotional discount codes. The conditions of any code are stated when it is issued, and these terms apply to all BROIL promotions, contests and discount codes unless stated otherwise:

• One promotion code per order. A code cannot be applied after the order is placed.
• Expired codes cannot be used, and codes cannot be exchanged for cash.
• A code issued to you is for your own account and for the purpose it was issued.
• Do not pass your code around or post it publicly — we are not obliged to replace a lost code, and misuse will cancel it.
• Codes may not be used to buy discounted stock for resale at a higher price.
• If a code is used in any of those ways, or in a way that abuses the spirit in which it was issued, we may cancel or withdraw it at any time without notice.

Website security

You may not violate, or attempt to violate, the security of this website. That includes:

• Accessing data not intended for you, or logging into an account or server you are not authorised to use.
• Probing, scanning or testing system vulnerability, or breaching security or authentication measures without authorisation.
• Interfering with service to another user, host or network — including submitting a virus, overloading, flooding, spamming, mail bombing or crashing.
• Sending unsolicited email, including promotions and advertising.
• Forging any TCP/IP packet header or header information in an email or newsgroup posting.

Indemnity, variation and entire agreement

You agree to indemnify and hold harmless BROIL Sensotek Industries, its directors, officers, employees, consultants, agents and affiliates against third-party claims, liability, damages and costs — including legal fees — arising from your use of this website or your breach of these terms.

We may amend, remove or vary the services or any page of this site at any time, at our discretion and without notice.

If any part of this agreement is found invalid or unenforceable, that part is replaced by a valid provision matching the original intent as closely as possible, and the rest stays in force. Except where product-specific terms are provided, this agreement supersedes all earlier representations, understandings or agreements, and prevails over any conflicting terms in an order you submit. Our not acting on one breach does not waive our right to act on a later or similar one.

Complaints

We run a complaint-handling procedure and would rather resolve a dispute when it first arises. Email info@broiltech.com, or use the support form. Dispatch times vary with availability, and any delivery guarantee is subject to postal delay or force majeure, for which we are not responsible.
